Terms & Conditions

These Terms & Conditions apply to photography services provided by Midnight & Chelsea Photography.

By confirming a photography booking, you agree to the booking terms provided to you for your session.

Bookings

A photography session is considered confirmed once any required booking information, agreement and deposit or session fee have been received.

Session availability cannot be guaranteed until your booking has been confirmed.

Session Fees & Payments

Prices, deposits, payment dates and what is included in your photography package will be explained at the time of booking.

Any additional photographs, products, travel or services requested outside the agreed package may incur an additional charge, which will be discussed with you before proceeding.

Cancellations & Rescheduling

We understand that life happens — especially when babies and children are involved.

If you need to reschedule your session because of illness or unexpected circumstances, please contact us as soon as possible and we will do our best to arrange another suitable date.

Cancellation, rescheduling and deposit conditions applicable to your particular session will be confirmed when you book.

Nothing in these terms limits any rights you may have under New Zealand consumer law.

Weather

For outdoor photography sessions, beautiful photographs depend on suitable weather and light.

If the weather is unsuitable, unsafe or likely to significantly affect the quality of your photographs, we may recommend changing the time, location or date of your session.

We want you to have photographs you'll love, so we'll work together to find the best alternative.

Children

We know children don't always perform on cue — nor do we expect them to!

Our sessions are designed to be relaxed and flexible, allowing children time to settle in, explore and simply be themselves.

Parents or guardians remain responsible for the supervision and safety of children throughout the photography session.

Locations

Sessions may take place at your home or at an agreed outdoor or other suitable location.

For location sessions we may consider travel distance, accessibility, weather, sunset times, lighting conditions and photographic opportunities when recommending the best location and session time.

Any significant travel costs or location fees will be discussed before your booking is confirmed.

Photography Style

By booking Midnight & Chelsea Photography, you acknowledge that you have viewed our portfolio and are familiar with our natural photographic and editing style.

Every session is different. Lighting, weather, location, children's moods and other circumstances can influence the final photographs, and an exact recreation of another image or session cannot be guaranteed.

Editing

Final photographs are professionally selected and edited in the Midnight & Chelsea Photography style.

Editing may include adjustments to colour, exposure, cropping and other appropriate enhancements.

RAW or unfinished image files are not normally supplied.

Delivery

Your photography package will specify the photographs, products or digital files included and the expected method of delivery.

Estimated delivery times may be provided following your session. If an exact timeframe has not been agreed, delivery will be made within a reasonable timeframe.

Copyright & Personal Use

Copyright ownership and the client's permitted use of photographs will be set out in the photography agreement applicable to the session.

Where agreed, clients may receive permission to reproduce and share their finished photographs for personal and family use.

Photographs must not be commercially reproduced, sold, substantially altered or supplied for commercial publication without the appropriate permission or licence.

Portfolio, Website & Social Media

We love sharing our work, but we also respect your family's privacy.

We will seek appropriate permission before using identifiable client photographs for purposes such as our website, portfolio, social media, advertising or promotional material.

Permission to use photographs publicly may be dealt with separately from your agreement to receive photography services.

Client Responsibility

Please let us know before your session about anything that may reasonably affect the photography, including accessibility requirements, location restrictions or other important considerations.

Where photography takes place at a location requiring permission, entry fees or permits, we will discuss responsibility for these arrangements before the session where applicable.

Consumer Rights

Our services are provided subject to applicable New Zealand law, including the Consumer Guarantees Act 1993 where it applies.

Nothing in these Terms & Conditions is intended to exclude or restrict any rights or remedies that cannot lawfully be excluded.
